Recitals.

These terms and conditions have been approved by and between a) 1 et 1 font 3, a company registered with the Paris Commerce and Companies Registry under number B 404 688 723 and having its registered office at 12 rue Vavin – 75006 PARIS (hereinafter "1 et 1 font 3"); and b) any person intending to make a purchase through the 1 et 1 font 3 website (www.1et1font3.com) (hereinafter the “User”).

1. Price

The prices of the products are denominated in euro and include VAT.
Our prices are guaranteed until 31 december 2007, save for any error or omission in the preparation of the website, in respect of which 1 et 1 font 3 shall not be held liable.
All orders are, regardless of their origin, payable in euro.
The price indicated on the product datasheets does not include the contribution to the processing and shipping expenses.
The price indicated in the order confirmation notice is the final price to be charged by 1 et 1 font 3.

1 et 1 font 3 reserves the right to change its prices at any time. However, products shall be charged on the basis of the prices in force upon registration of the orders, subject to availability at that time.

Title retention clause: the products shall remain the property of 1 et 1 font 3 until full collection of the price.

2. Payment terms

1 et 1 font 3 only accepts payments made by bank card, i.e. Visa, Eurocard / Mastercard or American Express.
Modes of payment such as bank transfers or payment against delivery are not admitted.
The amount of the invoice shall be debited from the user’s account upon the date of shipment of the goods. In the event of partial delivery, only the value of the goods actually delivered shall be debited.
Orders may be placed through the Internet, or by telephone, at 01.40.61.00.13.
No order validated by the customer shall be deemed effective unless and until the relevant banking payment centres have given their consent.
In the event of refusal by the said centres, the order shall be cancelled as a matter of right, and the customer shall be informed by e-mail. Furthermore, 1 et 1 font 3 reserves the right to refuse any order from any customer with whom a dispute is pending.
1 et 1 font 3 may reserve the right to seek from any customer a photocopy of any identity document bearing the name indicated upon placing the order.

3. Order

Automated recording systems are deemed to provide conclusive evidence as to the nature, content and date of the order.
1 et 1 font 3 confirms the acceptance of the customer’s order with the customer at the e-mail address communicated by the customer.
The sale shall be made only from the date of confirmation of the order and final receipt of the payment.
1 et 1 font 3 reserves the right to cancel any order from any customer with whom a dispute is pending concerning the settlement of an earlier payment.
The information provided by the buyer, upon the taking of the order, is binding on the buyer in the event of any error in the addressee’s particulars. In such case, the seller shall not be held liable for the impossibility of delivering the product.

4. Delivery

The delivery dates are provided as an indication only.
Orders shall be processed during the week following the receipt, within a maximum period of 30 days (absent any malfunction of the Post Office).
Deliveries shall be made as and when orders are received.
Deliveries shall be made in France and abroad through the French Post Office in a Colissimo registered package.
No late delivery shall give the buyer any right to seek any damages.
 

5. Delivery expenses

In the event of partial delivery, transportation expenses shall be charged only upon the first delivery.
Orders placed for delivery outside the European Community shall be charged without any VAT (VAT at the rate of 19.60%).
Upon their arrival, the said orders shall be subject to the local tax, except for Switzerland and Norway.

6. Products

The photographs showing the products are not a contractual term.
1 et 1 font 3 shall not be held liable in the event of any error in the said photographs.


7. Withdrawal

You may, within 15 days from receipt, return any new item(s) at your own expense, provided that they have not been worn, are contained in their initial packaging(s), are intact and are accompanied with the corresponding invoice.

Any and all shipping and return expenses shall then be borne by you. Only the price of the purchased product(s) shall then be reimbursed.

The reimbursement shall be made within 15 days from receipt of the return package.

8. Settlement of disputes

In the event of any dispute arising from this contractual relationship, the parties agree to seek an amicable solution prior to instituting any legal action.

The parties agree that any dispute arising from this Agreement shall be exclusively referred to the courts of PARIS (FRANCE).

9. Legal information

The supply of personal information collected for the purposes of distance sales is mandatory, as the said information is indispensable for the processing and routing of orders and for the preparation of invoices and warranty agreements.
Any failure to provide the required information shall result in the invalidation of the order. In accordance with the “Computing and Liberties” Act, the processing of the personal information concerning customers has been reported to the National Commission for Computing and Liberties (CNIL). The customer (Article 34 of the Act of 6 January 1978) has a right of access to, amendment to, correction of and deletion of any data concerning him.
In addition, 1 et 1 font 3 agrees not to communicate, whether free of charge or against valuable consideration, any data related to its users.
